These Terms & Conditions ("Terms") govern your access to and use of the website, studio facilities, services, session bookings, packages, and communications provided by Kellogg Photography ("Studio," "we," "us," or "our").
By booking a session, purchasing a package, or using our website, you agree to be bound by these Terms.
1. Photography Services
Kellogg Photography provides professional portrait photography services including, but not limited to:
Portrait sessions (individuals, families, couples)
Pet photography
Boudoir photography
Moms & family themed sessions
Digital image packages and print products
Online galleries and digital delivery
Session types, pricing, package inclusions, turnaround times, and delivery formats will be disclosed at the time of booking.
We reserve the right to update services, pricing, and policies at any time with reasonable notice.
2. Booking & Payments
Remaining balances beyond the deposit are due at or before the time of your session unless otherwise agreed in writing.
By booking a session or purchasing a package, you authorize Kellogg Photography to charge your selected payment method according to the agreed billing terms.
Failure to provide valid payment may result in cancellation of your session. See Section 3 for full deposit and cancellation terms.
3. Booking Deposit & Cancellation Policy
Kellogg Photography is a small boutique studio with limited availability. We depend to a very high degree on our appointment times being filled, and a missed or last-minute cancelled session has a significant impact on our business. We kindly ask that you respect this commitment. Weekends are our most in-demand times and cannot be easily filled on short notice in the event of a cancellation.
For these reasons, a deposit is required to secure your session booking.
Deposit
A deposit of $100–$150 is required to secure your portrait session for the agreed date and time.
Refunds & Credits
Cancellations made 10 or more days before your session: your deposit is 100% refunded.
Cancellations made fewer than 10 days before your session: your deposit is converted to a studio credit voucher that never expires and can be used on anything in the studio.
Any cancelled or missed (no-show) appointment automatically converts the session deposit into a studio credit voucher.
Arriving more than 20 minutes late will result in your deposit converting to a studio credit voucher and will no longer be refundable.
Studio credit vouchers are valued at $150 and may be applied toward any product or service we offer.
Rescheduling
Rescheduling within 15 days of your original appointment requires an additional $50 refundable deposit. This deposit is fully refundable after your rescheduled session is completed.
This policy exists because we have experienced situations where multiple reschedules resulted in gaps in our calendar that could not be filled. We appreciate your understanding.
4. Image Delivery & Turnaround
Edited images will be delivered via an online gallery within the timeframe disclosed at booking (typically [Insert Timeframe, e.g., 2–3 weeks]). Rush delivery options may be available for an additional fee.
The number of edited images included in your package will be disclosed at the time of booking. Additional images may be purchased separately.
Images are delivered in digital format. Print products, if ordered, are subject to separate production and shipping timelines.
5. Copyright & Image Usage
Kellogg Photography retains full copyright ownership of all images created during your session.
Upon full payment, clients receive a limited, non-exclusive personal use license to print and share their delivered images for personal (non-commercial) purposes.
Clients may not sell, license, or use images for commercial purposes without prior written consent from Kellogg Photography.
Kellogg Photography reserves the right to use session images for portfolio, website, social media, and marketing purposes unless a written privacy request is submitted prior to the session.
6. Model Release & Privacy
By booking a session, you grant Kellogg Photography permission to use your images (and images of any individuals in your session) for marketing and promotional purposes, including social media and website use.
If you do not wish to have your images used for marketing, please submit a written opt-out request before your session date.
For sessions involving minors, a parent or legal guardian must provide consent for participation and image usage.
7. Client Conduct & Studio Policies
Clients and their guests agree to:
Follow all studio rules and staff instructions
Treat equipment, props, and the studio space with care
Maintain respectful behavior toward staff and other clients
Arrive on time — late arrivals may result in a shortened session without refund
Kellogg Photography reserves the right to end a session early and withhold final images if a client engages in disruptive, abusive, or unsafe behavior.
8. SMS Terms & Conditions
By providing your mobile phone number and opting in through our website forms, you consent to receive SMS text messages from Kellogg Photography.
These messages may include:
Customer care and account notifications related to inquiries, bookings, sessions, and services
Marketing and promotional messages such as offers, promotions, or updates
Message frequency varies based on your interaction with us.
Message and data rates may apply.
You can opt out of SMS communications at any time by replying STOP to any message.

Consent to receive SMS messages is not required as a condition of purchase.
Your SMS consent is not shared with third parties or affiliates for marketing purposes.

No Condition of Purchase
Consent to receive text messages is not required as a condition of purchasing any goods, services, or session bookings.
Data Sharing & Non-Sale of Information
Mobile opt-in data will not be shared, sold, rented, or disclosed to third parties or affiliates for marketing purposes. We may use trusted third-party service providers (such as SMS delivery platforms, scheduling software, or CRM systems) to facilitate services under confidentiality agreements.
9. Website Use
All content on the Kellogg Photography website — including images, text, logos, and design — is the property of Kellogg Photography and may not be copied, reproduced, or distributed without prior written permission.
10. Limitation of Liability
Kellogg Photography is not responsible for injuries, property damage, or other losses that occur at the studio or during on-location sessions, except where required by law. Clients participate at their own risk.
In the unlikely event of equipment failure, file corruption, or other technical issues beyond our control, our liability is limited to a re-shoot or partial refund at our discretion.
